Don’t freak out!

It might not be as bad as it seems at first. Police often make mistakes. Prosecutors often overcharge cases. If you want a negotiated resolution to your case, it is more often than not possible to achieve. These resolutions often include pleas to less serious charges. Cases that should not have been filed in the first place are sometimes dismissed. It is important to take a deep breath because you will need to make solid, level-headed decisions.

If interacting with police...

If interacting with police, make sure you follow all their commands and directions. Resisting, fighting, or running from the police when they have lawfully detained you can lead to further charges against you. Don’t make unnecessary statements. Zip it! You will only make it worse. Don’t fight your accusations on the street by arguing or talking back. Your fight will be in the courtroom with an attorney by your side. Remember, you have the right to remain silent in the face of questioning about what happened. Say these words, “I want to remain silent and not answer any questions. I would also like to speak with an attorney as soon as possible.”

Plan to meet with an attorney.

Make sure you have a list of questions because you are bound to forget some of them during the initial consultation. Gather your paperwork and any other relevant items for the attorney to review. Tell your attorney about any evidence which you believe needs to be preserved right away. Your attorney should make you feel comfortable, have a strong command of the law and issues in your case, and be willing to communicate with you on a regular basis.

Define your goals.

Some people have no goal other than a complete dismissal of the charges against them. Some want their day in court. Some just want to soften the blow and get the lowest punishment possible, such as avoiding jail time, a driver’s licenses suspension, or a felony conviction. It will be important to discuss realistic desired outcomes with your attorney.

Research and hire your attorney.

Choosing somebody who meets your needs is an important decision. Most criminal defense attorneys know what you want to hear from them and will tell you. Do not select one of these attorneys. Pick somebody who will give a straight answer to a straight question. Pick somebody who has experience in criminal defense.
